US v. Yepiz, 09-50574

Conviction of racketeering and violence in aid of a racketeering enterprise is affirmed even though the "use it or lose it" voir dire practice followed by the district court impermissibly deprived defendant of two of the peremptory challenges to which he was entitled, where under a plain error standard of review, the court's error, although plain, and affecting defendant's substantial rights, did not seriously affect the fairness, integrity, or public reputation of the voir dire proceedings.
