In a petition for habeas relief, the District Court's ruling is: 1) affirmed as to the District Court's decision to grant the writ; but 2) vacated as to resentencing, as this remedy fails adequately to address the constitutional violation of ineffective assistance of counsel, which affected the entire plea negotiation stage of the proceedings in the Superior Court.
