Pacific Rivers Counsel v. US Forest Service, 08-17565
This court’s opinion filed on February 3, 2012 is withdrawn and replaced by this opinion: In a suit challenging the 2004 Framework, adopted by the Forest Service in regard to management of the Sierra Nevada Mountains, as inconsistent with the National Environmental Protection Act (NEPA) and the Administrative Procedure Act (APA), the grant of summary judgment to the Forest Service is: 1) reversed in part, where the Forest Service's analysis of fish in the 2004 Environmental Impact Statement does not comply with NEPA; and 2) affirmed in part, where the Forest Service's analysis of amphibians does comply with NEPA.
