United States Ninth Circuit
US v. California State Lands Commission, 10-56568
In an eminent domain case, wherein the US took a fee simple interest in about 32.42 acres of land on behalf of the Navy, and in so condemning the property, sought to extinguish California's public trust rights, the District Court's judgment in favor of the government is affirmed where the US can extinguish California's public trust rights when exercising its federal power of eminent domain.
