Leavitt v. Arave, 12-35427
In an appeal by convicted murder sentenced to death, brought under Federal Rule of Civil Procedure 60(b), claiming that Martinez v. Ryan, 132 S. Ct. 1309 (2012), renders him eligible to pursue ineffective assistance of counsel claims on which he had ostensibly defaulted, district court's denial of relief is affirmed.
