Harlick v. Blue Sheild of California, 10-15595

In a suit brought by a woman who suffers from anorexia nervosa seeking insurance coverage for her care at a residential treatment facility, either under the terms of her insurance plan or under California’s Mental Health Parity Act, the District Court grant of summary judgment to defendant-insurer is reversed where although her insurance plan, considered alone, does not require coverage, the Mental Health Parity Act does require coverage.
