United States Ninth Circuit
Ludwig v. Astrue, 10-35946
The district court's affirmance of an ALJ's denial of a claim for Social Security benefits is affirmed, where: 1) the ALJ erred by receiving an ex parte communication, assigning some weight to it, and denying a supplementary hearing to address it; but 2) there was no prejudice from the error, since the claimant did not demonstrate that the decision would have been any different without the ex parte communication.
