United States Ninth Circuit
US v. Perea-Rey, 10-50632
A conviction for harboring undocumented aliens is reversed, where the district court should have granted the defendant's motion to suppress evidence of aliens found at his home as the fruit of a warrantless search and seizure, because the agents physically occupied the curtilage of the defendant's home without obtaining a warrant, and no exceptions to the warrant requirement otherwise justified the search or seizure.
