United States Ninth Circuit
Ordonez v. US, 09-56533
In a case construed as a prisoner's request for equitable money damages from the government for unreturned personal items seized by the government during his arrest, the district court's grant of the government's motion to dismiss is affirmed, where sovereign immunity bars an award of money damages against the government on a motion under Rule 41(g) of the Federal Rules of Criminal Procedure where the property cannot be returned.
