Jimenez v. Franklin, 10-56199

In a case in which three of four defendants who were held jointly and severally liable for attorney's fees in a 42 USC section 1983 suit paid less than the full amount of the fee award and then sought satisfaction of judgment, the district court's orders of satisfaction are vacated, where the defendants waived their argument--that the joint and several nature of the attorney's fee award violated the cap on liability for fees found in the Prison Litigation Reform Act of 1995--by failing to appeal the order that included the fee award.
