Padilla v. Yoo, 09-16478
In a suit by a man held as an enemy combatant and his mother against a deputy assistant attorney general in the U.S. Department of Justice's Office of Legal Counsel, alleging that he set in motion the detainee's allegedly illegal interrogation and detention, the district court's denial of a motion to dismiss is reversed, where the defendant was entitled to qualified immunity, because at the time he acted the law was not sufficiently clear that every reasonable official would have understood that what he was doing violated the plaintiffs' rights.
