United States Ninth Circuit

US v. Dorsey, 10-30278

In a prosecution for crimes stemming from a conspiracy to traffic in stolen motor vehicles and then witness tampering, the judgment and sentence imposed on all counts are affirmed, where: 1) the district court did not abuse its discretion in admitting witness testimony about seeing the defendant with a gun before the shooting; 2) the prosecutor did not improperly vouch for a coconspirator's credibility when it elicited testimony on the truthfulness provisions of his plea agreement; 3) an improper comment by a detective that the defendant "did it" was not prejudicial; and 4) the district court permissibly sentenced the defendant to an 18-year term of imprisonment, as the sentencing range for a conviction under 18 USC section 924(c)(1)(A) is 10 years to life imprisonment.
