United States Ninth Circuit

Balla v. Idaho, 10-35413

In a case in which a law firm sought an award of fees under the Prisoner Litigation Reform Act in part for representing a class of prisoners in connection with their unsuccessful motion to hold the defendants in contempt for violating an injunction the prisoners had won, the district court's award of those fees is affirmed, where: 1) the firm's filing of the motion was a "catalyst" spurring the defendants to conform quickly to the injunction; and 2) a major reason why the motion was denied was that before it was heard, the defendants brought themselves into conformity with the injunction.
