United States Ninth Circuit
In re Pacific Pictures Corp., 11-71844
In a suit by the company that owns intellectual property rights to the Superman character against a movie producer-attorney, claiming that he interfered with its contractual relationships with the heirs of the creators of Superman, a petition for mandmaus challenging an order to produce documents is denied, where the petitioner waived attorney-client privilege by delivering the documents to the government pursuant to subpoena as part of a criminal investigation into the taking of the documents by a former employee of the attorney, and none of the petitioner's arguments for exception to the general rule of waiver by voluntary disclosure applied, including the theory that the petitioner made a "selective waiver."
