US v. Major, 10-10147

In consolidated appeals from convictions under 18 USC section 1951 for conspiracy to interfere with commerce by robbery and under 18 USC section 924 for various firearms offenses and the sentences imposed pursuant to section 924(c), the convictions are affirmed but the sentences are vacated, where: 1) the district court did not abuse its discretion in holding that evidence of other acts admissible under Federal Rules of Evidence 403 and 404(b); 2) the district court's order that the defendants not have any contact with anyone other than their attorneys did not deny their right to prepare for trial; 3) section 924(c) was not unconstitutional; and 4) for 924(c) sentencing purposes, the Ninth Circuit could not determine the order in which the jury found guilt on the offenses.
