United States Ninth Circuit
Alliance for the Wild Rockies v. Salazar, 11-35661
In a suit by environmental groups seeking to enjoin the implementation of a federal statute that orders the Secretary of the Interior to remove a portion of a distinct population of gray wolves from the protections of the Endangered Species Act, the district court's grant of summary judgment to the government defendants is affirmed, where: 1) the statute was an amendment of law applicable to pending litigation; and 2) the statute was entitled to be enforced, as it did not violate the separation of powers doctrine.
