Movsesian v. Victoria Versicherung AG, 07-56722
In a class action by Armenian genocide victims against various insurers under section 354.4 of the California Code of Civil Procedure, the district court's denial of a motion to dismiss the claims is reversed, as section 354.4 does not concern an area of traditional state responsibility and intrudes on the field of foreign affairs entrusted exclusively to the federal government, and so is preempted.
