In an appeal from a judgment of the district court granting the government's motion for summary judgment in its action to revoke defendant's citizenship, judgment is reversed where the district court improperly weighed the evidence in the record in concluding that a cooperation agreement which permitted defendant to retain his status as a legal permanent resident and to naturalize did not exist.
