Jewel v. NSA, 10-15616

In an appeal from a judgment of the district court dismissing plaintiffs' complaint alleging that the government impermissibly engaged in warrantless eavesdropping on US soil following the September 11, 2001, attacks, judgment is reversed where: 1) plaintiffs have standing In light of the detailed allegations and claims of harm; 2) the claims as alleged do not raise a political question; and 3) the plaintiffs are not subject to a heightened standing requirement simply because the case involves government officials in the national security context.
