In an appeal from an order of the district court dismissing, on summary judgment, plaintiff's Section 1983 and RLUIPA action challenging the enforcement of a land use regulation by the defendant, order is affirmed where: 1) plaintiff's claims were not ripe for review because it failed to apply for the required land use permit; and 2) equitable estoppel is unavailable.
