Ministry of Defense of Iran v. Cubic Defense Systems, Inc., 99-56444

In an appeal from a confirmation of an arbitration award by the district court, judgment is affirmed because entry of an award arising from the breach of a contract for sale and service of an air combat maneuvering range for use by Iran’s military is not, under the New York Convention, contrary to the public policy of the United States, but reversed where the district court incorrectly failed to exercise its discretion to award prejudgment interest and attorney’s fees.
