United States Ninth Circuit

Bravo v. City of Santa Maria, 09-55898

In an appeal from a judgment of the district court dismissing plaintiffs' Section 1983 action arising from a nighttime SWAT team search of their home, judgment is reversed because the plaintiffs presented sufficient evidence establishing a genuine issue as to whether officer's omission of a material fact on a warrant application was intentional or reckless.
