Johnson v. Finn, 10-15641

In an appeal from a judgment of the district court denying petitioners' application for habeas relief without an evidentiary hearing prior to vacating a magistrate judge’s credibility findings, judgment is reversed because the rule of US v. Ridgway extends to determinations by a magistrate judge as to the credibility of a prosecutor’s testimony at the second and third steps of a Batson inquiry.
