In an appeal from a judgment of the district court dismissing plaintiff’s complaint for construction defect as time-barred, judgment is affirmed because: 1) under Arizona law,American Pipe & Construction Co. v. Utah, 414 U.S. 538 (1974), does not toll the statute of repose for construction-defect claims; and 2) the state's savings statute is not applicable.
