United States Ninth Circuit

US v. Wilson, 09-10330

In an appeal from a judgment of the district court dismissing appellants' third-party petition to adjudicate interests in forfeited property acquired through a ponzi scheme, judgment is reversed where: 1) the district court erred in finding a lack of prudential standing because the Bennett zone of interests test does not apply; and 2) the government's interest in the forfeited assets is not superior to appellants'.
