Doe v. Busby, 08-55165

In an appeal from an order of the district court granting conditional habeas relief from petitioner's conviction for first degree murder and domestic violence, judgment is affirmed because: 1) petition was timely; and 2) the court correctly did not grant relief on the alternative ground that retroactive application of California Evidence Code section 1109 violated the Ex Post Facto Clause of the United States Constitution.
