James v. Schriro, 08-99016

In an appeal from a judgment of the district court denying petitioner habeas relief from his death sentence, judgment is affirmed with respect to petitioner's Brady, Giglio, and Napue guilt-phase claims, but reversed on petitioner's claim of ineffective assistance of counsel during the penalty-phase of his trial, where counsel's failure to investigate and present mitigating evidence of petitioner's troubled childhood, his mental illness, and his history of chronic drug abuse constituted deficient performance.
