In an appeal from a judgment of the district court denying defendant's motion to dismiss one count of a superseding indictment, judgment is affirmed where the Speedy Trial Act’s 30-day preindictment time limit restarts when the underlying complaint is dismissed without prejudice and the charges are later refiled.
