United States Ninth Circuit

US v. Fitch, Douglas N. Letter

In an appeal from a judgment of the district court convicting defendant of several bank-fraud and other related charges, conviction and sentencing are upheld where the court's substantial sentencing departure applied under U.S.S.G. section 5K2.1 on a finding, without a conviction, that defendant had murdered his wife and that her death was the means by which he committed his crimes was not substantively unreasonable nor an abuse of discretion.
