Maronyan v. Toyota Motor Sales, USA, Inc., 09-56949
In an appeal from a judgment of the district court dismissing, for lack of subject matter jurisdiction, plaintiff's action for breach of warranty under the Magnuson-Moss Warranty Act (MMWA), judgment is reversed where plaintiff's failure to comply with the MMWA's requirement that a consumer resort to an informal dispute settlement procedure before filing a civil action does not deprive the court of subject matter jurisdiction.
