Johnson v. Poway Unified School District, 10-55445

In an appeal from a judgment of the district court granting summary judgment and injunctive and declaratory relief in favor of the plaintiff, judgment is reversed where a public school district may, without offending the First Amendment, prohibit an employee from using his public position as a pulpit from which to preach his own views on the role of God in our Nation’s history to the captive students in his mathematics classroom.
