In an appeal from a judgment of the district court denying petitioner's petition for habeas relief from his conviction of first-degree murder and other related offenses, judgment is affirmed where petitioner's challenge to California's lethal injection protocol is dismissed as premature, and where to the extent the trial court committed any error, such error did not render petitioner's trial fundamentally unfair.
