In an appeal from a judgment of the district court dismissing the first of two companion environmental tort actions and remanding the second action to state court, judgment is affirmed where the first action, a claim for damages, fall within the scope of Colorado River Water Conservation Dist. v. United States, while the court had discretion under Wilton v. Seven Falls Co. and Brillhart v. Excess Ins. Co. of Am. to remand the second, declaratory judgment action.
