United States Ninth Circuit
Jackson v. Ryan, 10-15067
In an appeal from a judgment of the district court denying defendant's petition for habeas relief from his first-degree murder conviction, judgment is reversed where the court failed to conduct a Strickland inquiry because it rejected defendant's claim that the trial court's felony murder instruction was erroneous.
