United States Ninth Circuit
Chism v. Washington State, 10-35085
In a Section 1983 action arising from a disingenuous search and failed prosecution of plaintiff for child pornography, summary judgment in favor of the officers is reversed where viewing the evidence in the light most favorable to the plaintiff, the plaintiffs made a substantial showing of the officers' deliberate falsehood or reckless disregard for the truth and established that, but for the dishonesty, the searches and arrest would not have occurred.
