US v. Clements, 09-10034

Conviction of defendant for failing to register as a sex offender, 18 U.S.C. section 2250, is vacated where for persons convicted of sex offenses prior to the enactment of SORNA, 42 U.S.C. sections 16911, 16913, SORNA's registration requirements did not become effective until thirty days after the Attorney General published guidelines that accorded with the Administrative Procedure Act's (APA) requirements and announced SORNA's retroactive applicability, thus the Attorney General's interim regulation in the case did not comply with the APA.
