United States Ninth Circuit

Ren v. Holder, 08-71315

In a petition for a review of an order of the BIA denying petitioner's application for asylum, withholding of removal, and protection under the CAT, petition is denied where although the immigration judge's adverse credibility determination was impermissibly based on mischaracterizations of petitioner's testimony as well as inconsistencies that, considering the totality of the circumstances, were trivial, petitioner, a native and citizen of China, was given the proper notice and opportunity to respond to a request for corroborative evidence but failed to provide such evidence and did not provide any explanation for his failure to do so.
