In a dispute involving a claim against the defendant by a former public high school student alleging that his history teacher violated his rights under the Establishment Clause by making comments during class that were hostile to religion in general, and to Christianity in particular, judgment of the district court dismissing complaint on qualified immunity grounds is affirmed, where the law was not clearly established at the time of the events in question, and because resolution of the dispute need not reach the constitutional propriety of the teacher's conduct.
