United States Ninth Circuit

Miranda v. Braatz, 10-15308

In a petition for habeas relief from the sentencing of petitioner to a term of 910 days' imprisonment for multiple criminal violations arising from a single criminal transaction, judgment of the district court granting relief is reversed where the Indian Civil Rights Act, 25 U.S.C. section 1302, does not prohibit a tribal court from imposing consecutive sentences cumulatively exceeding one year for multiple criminal violations arising from a single criminal transaction.
