Yonemoto v. Department of Veterans Affairs, 10-15180
In an interlocutory appeal concerning an FOIA dispute involving Exemption 6 redactions of certain emails disclosed by defendant, partial summary judgment in favor of the defendant is affirmed in part, reversed in part and remanded where: 1) an agency may not fulfill its disclosure obligation by offering to supply the documents to the requester, but only in his capacity as an employee of that agency; and 2) the court erred in its Exemption 6 rulings.
