United States Ninth Circuit

US v. Della Porta, 10-50168

In a dispute concerning the authority of the district court to use supplemental closing arguments to assist a deadlocked jury, judgment of the district court is affirmed where court’s decision to permit supplemental closing argument did not result in impermissible coercion and did not constitute a prejudicial abuse of discretion because the court never gave an Allen charge.
