United States Ninth Circuit

Alpha Delta Chi-Delta Chapter v. Reed, 09-55299

In a constitutional challenge to the defendant-university's nondiscrimination policy as applied to a Christian student group, summary judgment in favor of defendant is affirmed where the policy does not violate plaintiffs’ rights of free speech and expressive association, free exercise of religion, and equal protection, but reversed where the evidence raises a triable issue of fact as to whether the defendant arbitrarily applied such policy.
