Hoye v. City of Oakland, 09-16753

In a Section 1983 action challenge defendant-city's enforcement of an ordinance which prohibits certain conduct within 100 feet of abortion clinics, summary judgment by the district court is affirmed where the ordinance is facially constitutional, but reversed with respect to the defendant's enforcement of the ordinance since such enforcement is a constitutionally invalid, content-based regulation of speech.
