Pickard v. Department of Justice, 08-15504

In an action seeking to enforce plaintiff-inmate's Freedom of Information Act request to the Drug Enforcement Administration for records pertaining to a confidential informant and concerncing the scope of the Glomar response, summary judgment in favor of defendant is reversed where because the government officially confirmed the informant's status in open court and during official proceedings, the government cannot invoke a Glomar response by neither admitting nor denying the informant's status in response to a FOIA request.
