Sentencing of defendants for smuggling methamphetamine into the United States following modification orders retroactively terminating state-court probationary sentences are reversed where federal district courts, in calculating criminal history points for purposes of safety valve eligibility, must credit state orders terminating probationary sentences because of the wide latitude in modifying probationary terms given to state courts.
