Horne v. US Department of Agriculture, 10-15270
In a dispute involving the constitutionality of a food product reserve program authorized by the Agricultural Marketing Agreement Act (AMAA) U.S.C. section 601 et seq., summary judgment of the district court affirming the imposition of civil penalties and assessments for plaintiffs' failure to comply with the reserve requirements of the AMAA, among other regulatory infractions, is affirmed where administrative order mandating compliance and the imposition of penalties are constitutional.
