Beeman v. Anthem Prescription Management, LLC, 07-56692
In a diversity action to enforce California Civil Code sections 2527 and 2528, judgment of the district court denying defendants' motions for judgment on the pleadings is affirmed because Erie does not mandate deference to state appellate court decisions striking down section 2527, nor does section 2527 unconstitutionally compel speech under either the United States or California Constitution.
