In a challenge to defendant's determination that plaintiff, an under-performing bilingual student, did not qualify for special education under the Individuals with Disabilities Education Act (IDEA), judgment of the district court upholding defendant's determination is affirmed with respect to plaintiff's claim that he qualified for special education and related services as a child with ADD/ADHD and reversed and remanded for a determination of whether, during all relevant times, defendant met its obligation to locate, evaluate, and identify plaintiff as a child with a specific learning disability.
