Hurles v. Schriro, 08-99032
In a petition for habeas relief from petitioner's conviction of first-degree murder, judgment of the district court denying petition is reversed on the basis of judicial bias where trial judge became involved as a party in an interlocutory appeal, was denied standing to appear as an adversary, and then proceeded to preside over petitioner's murder trial and single-handedly determine his death sentence.
