Nichols v. Dancer, 10-15359

In a Section 1983 dispute arising from the forced retirement of plaintiff based on her public association, summary judgment in favor of defendant school district is reversed where there is no evidence that plaintiff's association actually disrupted her performance or reasonably threatened to cause future disruption to her work such that defendant's interests in work efficiency outweighed plaintiff's right to free association.
